Terms and conditions

  1. Information on how to enter and prize details form part of these conditions of entry. Entry into the Promotion is deemed acceptance of these conditions of entry.
  2. The Promoter is Telstra Corporation Limited (ABN 33 051 775 556) of Level 2, 400 George Street, Sydney, NSW 2000 ("Promoter").
  3. The Promotion will be open from 8:30am Australian Eastern Standard Time ("AEST") on 10 May 2008 and ends at 6:00pm AEST on 10 September 2008 ("Promotion Period").

Entry

  1. Entry is open to teams, consisting up to 18 players, provided they meet one of the following criteria;
    1. all junior rugby league teams
      1. representing an affiliated junior rugby league club which is registered with a local District League/Group; and
      2. playing in an affiliated junior rugby league competition which is administered by a local District League/Group, which is affiliated with either ARL, NRL, NSWRL, CRL, QRL, NTRL, SARL, VRL or WARL.
      Or
    2. school and Rugby League Program participants that have participated in a Rugby League competition, Rugby League Gala Day or Rugby League Development Program
    Each constitutes an Eligible Team in a Competition
  2. For an Eligible Team to enter the Promotion and be eligible to win, an authorised representative of the Eligible Team must, during the Promotion Period and on the Eligible Team's behalf:
    1. have a member of the Eligible Team (player, coach, parent or guardian) capture a MMS video recording of the Eligible Team's post-try celebration performance ("Performance"); and
    2. send MMS video to 0437 K2K MMS (0437 525 667) for uploading onto www.beinvolved.telstra.com (the "Website").
    ("Eligible Video")
  3. An Eligible Performance of an Eligible Team can be no longer than one minute and must only feature members of the Eligible Team participating in the Competition on the day of entry ("Performers").
  4. There will be three (3) entry and voting periods ("Entry Period") during the Promotion Period within which Eligible Teams will upload their Performance, as set out in the table below.

  5. Members of the public will be able to vote for the Eligible Video that they think is the most creative and original for that Entry Period.
  6. The Eligible Team whose Performance receives the most votes from the public from all Eligible Videos during each Entry Period ("Monthly Winner"); will win the prize detailed in clause 13 below.
  7. In the event of a tie whereby two or more Eligible Teams have the same amount of total votes for a particular Entry Period, the Promoter will determine the winner by selecting, in its discretion, the Eligible Video from the tied Eligible Videos that it believes is the most original and creative.
  8. This is a game of skill only and chance plays no part in determining the winner.
  9. Limit of one vote per computer per day.

Prizes

  1. The Prize for each Monthly Winner will consist of a Telstra Assistance Fund Pack including rugby league equipment worth $1,500 ("Minor Prize"). Three Minor Prizes will be distributed in total.
  2. The winner of the overall Promotion will be chosen from the highest number of votes as well as the most creative and original entry as judged by Brad Fittler and Russell Barwick ("Major Prize Winner").
  3. The Prize for the Major Prize Winner will consist of;
    1. presenting medals on the podium to the winning and runner up teams at the 2008 NRL Grand Final;
    2. accommodation at the Novotel Olympic Park for Sunday, 5 October 2008 for the team and parents/guardians; and
    3. $500 for each player (18) and $500 for each guardian (2 required) for airfares and transfers where required.
  4. Major Prize Winners to be announced by Russell Barwick on BigPond Sports Weekend on Saturday, 13 September 2008
  5. Total Prize value does not exceed $25,000.
  6. Winners who participate in the Eligible Video will be required to be accompanied by their parent or legal guardian when taking the Prize.
  7. Prizes are not transferable or exchangeable and are not redeemable for cash. If the Promoter is unable to provide a winner with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value. The Promoter is not obliged to supply substitute prizes where the winner does not satisfy the conditions of use for any element of the prize, or does not accept any element of the prize. The Promoter takes no responsibility for any variation in the value of the Prize. Prize suppliers’ terms and conditions of use apply.
  8. All other costs associated with the prizes (including, but not limited to, transfers, additional meals, taxes and insurance) are the responsibility of the winners. It is a condition of taking the prize that the winners take appropriate travel insurance. Flights and accommodation are subject to availability at the time of booking and the prize does not include penalty fees payable upon the winners’ consent to change a booking once confirmed.
  9. The winners must be available to travel on the specified dates and be in Sydney on 5 October 2008.
  10. Winning Teams will be notified on the corresponding date as set out in the table above, and published on www.beinvolved.telstra.com 8 days post the closure of the Entry Period. Prizes will be delivered by a representative of the Promoter within four weeks of the winner's notification.
  11. If any Prizes remain unclaimed by 31 December 2008, they will be distributed at the Promoter's absolute discretion.

General

  1. The Promoter may, in its absolute discretion, deny votes for Eligible Videos where computer-generated or other viral methods of voting appear to distort or manipulate votes and where this may affect the integrity of the voting mechanism.
  2. Incomplete, ineligible and incorrect entries or entries containing offensive or defamatory comments, or which infringe third party intellectual property rights are not eligible to win.
  3. The Promoter is not responsible for technical difficulties with the entry mechanisms and does not warrant that the entry mechanisms will be available at all times.
  4. Any Eligible Team that, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process will be ineligible to win.
  5. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry and the Promoter's decisions in relation to any aspect of the Promotion are final and binding. No correspondence will be entered into.
  6. By participating in the Promotion, an Eligible Team warrants that it has the consent of all Performers featured in its Eligible Video (or their parent or guardian if the individuals are under 18 years of age) to appear in the Eligible Team’s Eligible Video for the purposes of this Promotion and for the Promoter to use the Eligible Team's Eligible Video in accordance with clauses 30 and 31 below. Each Eligible Team agrees to fully indemnify the Promoter against any loss, damage or third party claims that the Promoter suffers by virtue of the Eligible Team not complying with this clause, and for any use by the Promoter of Eligible Videos entered (whether taken by the Promoter or otherwise) that infringes a third party's intellectual property rights.
  7. By participating in the Promotion, the Eligible Team understands and agrees (and warrants that the Performers featured in its Eligible Video understand and agree (or their parents or legal guardian if they are under 18 years of age) that the Promoter may use and disclose the information provided by and on behalf of the Eligible Team and the Performers on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059 as if they were a customer of the Promoter, and to disclose to organisations associated with the conduct of the Promotion and provide any material submitted by an Eligible Team as part of this Promotion for publishing in the media. This express consent has an unlimited life. If the Eligible Team or the Performers would like to access or correct the personal information that the Promoter holds about the Eligible Team or the Performers, or if the Eligible Team or the Performers do not wish the information to be disclosed, the Eligible Team or the Performers should advise the Promoter by phoning 1800 039 059.
  8. By participating in the Promotion, the Eligible Team agrees and acknowledges, and warrants that all Performers featured in its Eligible Video (or their parent/legal guardian on their behalf if they are under 18 years old) agree and acknowledge that (and may be required to sign a document to the effect that):
    1. the Eligible Team and Performers may be contacted by the Promoter to provide comments about the Promotion (which the Promoter may supplement with video, text or other materials at the Promoter's discretion) and to participate in the Promoter’s publicity activities as reasonably requested, including being photographed by the Promoter (or an agent of the Promoter);
    2. the Promoter may use such comments, photos and Eligible Videos (the "Materials") for the Promoter's promotional and marketing purposes without further reference or compensation to the Eligible Team or the Performers;
    3. the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
    4. by participating in the Promotion, they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose including but not limited to the publishing of the Materials in any media;
    5. they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
    6. they waive all Moral Rights in the Materials that arise outside Australia; and
    7. they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
  9. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.
  10. The Promoter accepts no responsibility for any tax liabilities that may arise from winning a Prize.
